For those involved in hiring employees, on the one hand, there’s nothing better than realizing that you’ve hired a great employee. On the other hand, there’s nothing worse than realizing that you’ve hired a terrible employee. While there is no magic formula or algorithm that will lead you to always hiring great employees or avoid being sued by a rejected applicant, there are bad, good, and better practices that can reduce the risk not only of hiring a bad employee, but also avoiding litigation over a failure (or failures) to hire. Similarly, at the end of the employment relationship, there are bad, good, and better practices that also can reduce the risk of being sued by the terminated employee(s).
 
This full-day seminar will cover the legal risks at inception and at cessation of the employment relationship to try to help you avoid having to hire the speakers (or other lawyers of their ilk) to defend you in a lawsuit over the hiring or firing decision.

Attorney Jimmy Oh has seen and done it all (well, almost all), practicing in the employment law space for more than three decades. His experience over that time has included the following:
 
  • Successfully trying a wage and hour collective and class action in Columbus, Ohio; an ADA and ADEA case in Atlanta, Georgia; an FLSA case in Anchorage, Alaska; and a pregnancy discrimination case in Chicago, Illinois
  • Defending his victories in multiple Courts of Appeal
  • Obtaining temporary restraining orders and preliminary injunctions in restrictive covenant and trade secret matters and defeated applications for the same
  • Successfully suing state governments that certain state laws are preempted by ERISA
  • Obtaining summary judgment in employment discrimination cases in multiple courts around the country
  • Drafting affirmative action plans and defending companies during OFCCP audits
  • Advising companies on the “future of work” amid the COVID-19 pandemic

 
 
Employers look to Danny Simandl as a counselor and litigator in key areas of labor and employment law. He helps them create workplaces that optimize operations and benefit their workforces, and he takes a proactive approach to policy development and implementation to ensure employers are always covered and employees are never taken by surprise.
Clients also rely on Danny for guidance on matters involving the Occupational Safety and Health Act, the Americans with Disabilities Act, the Affordable Care Act, the Employee Retirement Income Securities Act, and the Family and Medical Leave Act.

Danny has litigated and settled employment disputes involving disability discrimination, trade secrets, and non-compete agreements brought in state and federal courts. Alongside that experience, Danny has negotiated collective bargaining agreements and handled labor disputes, including grievances and unfair labor practices, and has provided onsite counseling during strikes.
